Why is BABA compliance important?
If you’re using funding that was provided through The Bipartisan Infrastructure Law, or any of the programs it encompasses, to purchase products, those products must comply with the Build America Buy America (BABA) Act.
The BABA Act mandates that all of the iron, steel, manufactured products and construction materials used in the product must have been mined, produced or manufactured within the United States. Together, those materials must represent at least 55% of the cost of the finished product.
A number of connectivity-related funding programs fall under The Bipartisan Infrastructure Law, so if you’re using funds from these programs to purchase products, you’ll need to ensure the products are BABA-compliant. They include:
- The Broadband Equity, Access, and Deployment (BEAD) Program
- The Affordable Connectivity Program
- Digital Equity Planning, Capacity and Competitive Grants
- The Tribal Broadband Connectivity Program
- Rural Broadband Programs at the Department of Agriculture
- The Middle Mile Grant Program
- Private Activity Bonds
